2026 MOCKINGBIRD ELEMENTARY CARNIVAL
WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
In consideration for receiving permission to attend and/or participate in the 2025 Mockingbird Elementary Carnival, including its rides, games, petting zoo, and other attractions, the undersigned, on his or her behalf, and on behalf of the participant(s) named below, voluntarily acknowledges, appreciates and agrees to the following:
I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE, Mockingbird Elementary, Dallas Independent School District, Mockingbird Elementary PTA, their sponsors, officers, agents, volunteers, organizers, servants, and/or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me and/or any participant(s) named below, or any of the property belonging to me and/or any participant(s) named below, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, while attending or participating in any activity at the 2025 Mockingbird Elementary Carnival, or while in, on or upon the premises where the 2025 Mockingbird Elementary Carnival is being conducted.
I, on behalf of myself and as parent or legal guardian of the participant(s) named below, am fully aware of the risks and hazards associated with carnival activities, including rides, games, petting zoo, and other attractions, and I hereby elect to voluntarily participate in and/or allow the minors named below to participate in said activities with full knowledge that such activities may be hazardous to me and/or the participants named below and my/their property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me and/or the participants named below, or any loss or damage of property owned by me and/or the participants named below, as a result of being engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE.
I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to my and/or the participants named below participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES OR OTHERWISE.
It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall apply to and bind the family, spouse, heirs, assigns and personal representative, if deceased, of me and/or the participants named below and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the below-named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Texas.
IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed. No oral representations, statements, or inducements, apart from the foregoing written agreement, have been made to me. I am at least eighteen (18) years of age and fully competent. I understand that this Release is a binding contract, and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.
I, as parent or legal guardian of the participant(s) named below, who is/are under the age of 18, consent to the minor’s participation in the 2025 Mockingbird Elementary Carnival, including its rides, games, petting zoo, and other attractions and consent for Mockingbird Elementary and Mockingbird Elementary PTA to seek reasonable and necessary medical treatment for the participant(s) during the 2025 Mockingbird Elementary Carnival, and agree to be responsible for any cost of such treatment.
